Agreement to Terms

You may not create more than one account per person, create accounts for others without their consent, or create an account using a false identity or another person’s information. Accounts are non-transferable and may not be sold, shared, or assigned to another party.

Payments and Pricing

Yinare reserves the right to change prices at any time. Price changes will not affect orders already confirmed unless expressly stated. FTC Compliance: All pricing, charges, and billing practices comply with applicable FTC regulations including the Restore Online Shoppers’ Confidence Act (ROSCA) requirements for clear disclosure of material terms before charging.

Refunds and Cancellation Policy

Our refund policy is as follows:

  • Digital products and downloads: Due to the nature of digital products, all sales are final once the product has been accessed or downloaded, unless the product is defective or materially different from its description.

  • Chargebacks: Initiating a chargeback without first contacting us is a violation of these Terms. We reserve the right to suspend your account and pursue recovery of any chargeback amounts plus fees.

Intellectual Property

Termination and Suspension

Yinare reserves the right to suspend, restrict, or terminate your access to the Service at any time, with or without notice, for any of the following reasons:

  • Actions that we reasonably believe may harm Yinare, other users, or third parties
  • Legal or regulatory requirements
  • Technical or security reasons
  • Non-payment of any fees due

You may terminate your account at any time by contacting info@yinare.com or using the account deletion feature in your settings. Upon termination, your right to use the Service immediately ceases. Provisions of these Terms that by their nature should survive termination — including intellectual property, limitation of liability, indemnification, and dispute resolution clauses — shall survive.

Termination does not entitle you to a refund of any fees paid, except where a refund is expressly required under our Refund Policy or applicable law.

Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YINARE EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • Warranties that the Service will be uninterrupted, error-free, or free of viruses or other harmful components
  • Warranties regarding the accuracy, completeness, reliability, or timeliness of any content or information on the Service

No advice or information, whether oral or written, obtained by you from Yinare or through the Service shall create any warranty not expressly stated in these Terms.

Australian Consumer Law: Nothing in this warranty disclaimer excludes, restricts, or modifies any guarantee, right, or remedy conferred on consumers under the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL YINARE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, BUSINESS INTERRUPTION, OR OTHER INTANGIBLE LOSSES — ARISING OUT OF OR IN CONNECTION WITH:

  • Your access to or use of (or inability to access or use) the Service
  • Any content or conduct of any third party on the Service
  • Unauthorised access, use, or alteration of your transmissions or content
  • Any other matter relating to the Service

Indemnification

You agree to defend, indemnify, and hold harmless Yinare, its parent company Yinare, its affiliates, and their respective officers, directors, employees, agents, and successors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of or access to the Service in violation of these Terms
  • Your violation of any applicable law, regulation, or third-party right
  • Any misrepresentation made by you in connection with your use of the Service

Yinare reserves the right, at its own expense, to assume the exclusive defence and control of any matter subject to indemnification by you, in which case you agree to cooperate fully with Yinare‘s defence of that matter.

Dispute Resolution

Informal Resolution: Before initiating any formal dispute, you agree to first contact Yinare at info@yinare.com and provide a written description of the dispute, including your name, a description of the issue, and the relief sought. We will attempt to resolve the dispute informally within 30 days of receipt of your notice.

Governing Jurisdiction: Any disputes shall be submitted to the exclusive jurisdiction of the courts of the jurisdiction in which the business is domiciled. Both parties consent to personal jurisdiction in that forum.

Minors and Age Restrictions

The Service is not intended for use by individuals under the age of 18 (or the legal age of majority in your jurisdiction). By using the Service, you represent and warrant that you are at least 18 years of age. If we discover that a user is under 18, we will terminate their account and delete any associated data promptly.

  • Force Majeure: Yinare shall not be liable for any delay or failure to perform its obligations under these Terms due to circumstances beyond its reasonable control, including acts of God, natural disasters, war, terrorism, industrial disputes, or failures of the internet or third-party infrastructure.
  • No Partnership: Nothing in these Terms creates a partnership, joint venture, agency, franchise, or employment relationship between you and Yinare.
